Agreement to Terms

By accessing or using Pressly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

Description of Service

Pressly is a WordPress backup and optimization platform that provides:

  • Automated and manual WordPress site backups
  • Cloud storage integration (Google Cloud, S3, Google Drive, FTP, SFTP)
  • Backup restoration capabilities
  • Site migration tools
  • Performance optimization features
  • Multi-site management (for Pro plans)

Account Registration

To use Pressly, you must:

  • Be at least 18 years old or have parental consent
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Transmit malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service or servers
  • Use the Service for illegal or unauthorized purposes
  • Backup or store illegal content
  • Exceed your plan's storage or usage limits without upgrading

Subscription Plans and Billing

Free Plan

Pressly offers a free plan with limited features and storage. Free plan users receive:

  • 3GB of Pressly Cloud storage
  • Basic backup and restore functionality
  • Community support

Paid Plans

Paid plans are billed monthly or annually. By subscribing to a paid plan, you agree to:

  • Pay all fees associated with your plan
  • Automatic renewal unless cancelled
  • Price changes with 30 days notice
  • No refunds for partial billing periods (unless required by law)

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of your paid period.

Data and Backup Responsibility

While we provide backup services, you are responsible for:

  • Maintaining your own backups in addition to Pressly backups
  • Verifying backup integrity and completeness
  • Ensuring you have proper rights to backup all content
  • Testing restore procedures regularly
  • Protecting your storage credentials

Pressly is not responsible for data loss resulting from user error, corrupted backups, or failure to maintain proper backup procedures.

Intellectual Property

The Service and its original content, features, and functionality are owned by Pressly and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to your WordPress site content and backups. We claim no ownership rights over your data.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WP VAULT SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions or unavailability
  • Data loss or corruption
  • Third-party service failures (storage providers, hosting, etc.)

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Service Availability

We strive to maintain high availability but do not guarantee:

  • Uninterrupted or error-free service
  • 100% uptime
  • Immediate backup or restore completion
  • Compatibility with all WordPress configurations

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

Third-Party Services

Pressly integrates with third-party services including:

  • Cloud storage providers (Google Cloud, AWS S3, etc.)
  • OAuth providers (Google, GitHub)
  • Payment processors

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Extended account inactivity

Upon termination, your right to use the Service will cease immediately. You may request deletion of your data, subject to our data retention policies.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the appropriate courts.

By using Pressly, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the Service.
